SCOPE AND PURPOSE

Access to and use of the Raffles Site is governed by these terms of use, which define the terms and conditions of use of the Raffles Site and the relations between ACCOR and any person who accesses or browses the Raffles Site (the “User”). These terms of use are available and can be viewed at any time on the Raffles Site. The User can also print or download these terms of use.

The Raffles Site allows the User to view information and Content concerning Raffles hotels, activities and news, for the User’s personal and private, non-commercial use. The User can also make a reservation on the Raffles Site in accordance with the General Terms and Conditions of Services.

ACCOR will make reasonable efforts to ensure that the information and Content on the Raffles Site is accurate and up to date, but reserves the right to correct and/or modify all or part of the Raffles Site and/or the terms of use at any time and without notice. Any such changes to the terms of use shall take effect on the date posted on the Raffles Site and the User’s use of this Raffles Site after such changes have been posted will mean that the User accepts and agrees to all such changes. ACCOR will inform the User of any material changes to these terms of use by any means of its choice, including by the display of a banner on the Raffles Site.

The applicable terms of use are those in effect on the date of browsing the Raffles Site. Accordingly, if the User views or browses the Raffles Site, the User will be deemed to have read and accepted the terms of use in effect and to have agreed to abide by them. If the User do not accept these terms of use or any part of them, he/she shall not use or browse the Raffles Site.

COPYRIGHT

The Raffles Site's presentation and each element, including the domain name, trademarks, logos, brand names, drawings, illustrations, photographs, texts, graphics and other files found on this site, are protected by the current intellectual property laws and belong to ACCOR or have been authorised for the use of ACCOR.

No element found on the Raffles Site may be copied, reproduced, modified, reissued, loaded, altered, transmitted or distributed in any way whatsoever or in any form whatsoever, either partially or fully, without the prior written authorisation of ACCOR, except in the case of strictly personal, private and non-commercial use, without changing the current elements on the Raffles Site.

The following must accompany all full or partial copies of the Raffles Site's content: "Copyright Accor SA. The photographs used on raffles.com are non-binding."

Any other use of the Raffles Site or the elements therein without express authorisation would be considered an infringement upon the rights of ACCOR and indictable as counterfeit under articles L. 355-2 et seq. of the French Intellectual Property Code.

ACCOR'S RIGHTS AS THE PRODUCER OF A DATABASE

All clients, customers, prospects and partners have the non-exclusive, untransferable and inalienable personal right to view the information found on the Raffles Site for their own hotel reservation needs

They may extract and/or reuse part of the Raffles Site's Content for personal viewing purposes, as long as this extraction and/or reuse does not concern a substantial (either in terms of quality or quantity) portion of the Raffles Site's Content. Moreover, it is prohibited to extract and/or reuse any of the Raffles Site's Content repeatedly, even if the Content is not substantial.

Any full or partial reproduction of the Raffles Site for other means is strictly prohibited by articles L. 342-1 and L. 342-2 of the French Intellectual Property Code. It is also prohibited to communicate to the public all or part of the Raffles Site's Content, in any form and to any audience whatsoever.

In particular, it is strictly prohibited to use the Raffles Site's Content for commercial purposes.

LIABILITY

The Raffles Site and its Content are provided “as is” subject to availability. The User is solely responsible and liable for its use of the Raffles Site and the Content, and in particular for complying with its obligations under these terms of use.

ACCOR does not warrant uninterrupted availability of the Raffles Site or its Content, or that the Raffles Site or its Content will be error-free. The Raffles Site is normally available 24 hours a day, 7 days a week, subject to events of force majeure, the availability of the internet and/or suspensions of the Raffles Site due to technical reasons in connection with updates to the Raffles Site, Raffles Site maintenance or any other technical cause. ACCOR is under a duty of reasonable care in providing access to the Raffles Site under the conditions set forth in these terms of use, and in attempting to remedy any malfunction, suspension or interruption of the Raffles Site that is brought to its knowledge. The User acknowledges and accepts that ACCOR may be required to temporarily or permanently suspend access to the Raffles Site without notice, in particular for technical and/or maintenance reasons, irrespective of their cause or origin, without this entailing any liability whatsoever for ACCOR.

It is further specified that the internet and the information and telecommunication systems used to access and use the Raffles Site are not error-free or bug-free and that interruptions and failures may occur from time to time. ACCOR disclaims any and all liability for any inconvenience, loss or damage in connection with the use of the internet, in particular but without restriction, poor transmission and/or receipt of any data and/or information over the internet, the failure of any receiving equipment or lines of communication, any malfunction of the internet preventing the proper operation of the Raffles Site and, more generally, any loss or damage arising out of the use of the Raffles Site, the internet and information and telecommunication systems. Neither ACCOR nor its directors or employees shall be liable for any loss or damage, howsoever caused, arising out of a use of the Raffles Site, for which the User is solely responsible. The Raffles Site may contain links to other web sites, which are not being maintained by ACCOR. ACCOR cannot be held responsible for the information, products, services or other material obtained on such other web sites and will not be liable for any damages arising from the access to or use of such a web site. The inclusion of these links does not imply an endorsement of the linked sites, the Content therein including any linked addresses.

No linking without consent of Raffles
The linking of other web sites to the Raffles Site is prohibited without express, prior written consent of ACCOR.

PERSONAL DATA AND COOKIES

Users are informed that the Raffles Site uses cookies and that ACCOR processes personal data. In this regard, Users are invited to read the Charter on the Protection of Customers' Personal Data.

GOVERNING LAW AND JURISDICTION

Any request for information, clarification, assistance, or complaint in connection with the Raffles Site should be sent to ACCOR by email or by postal mail to the addresses indicated at the top of this document.

These terms of use are governed by, and shall be construed in accordance with, the laws of France.

In case of any complaint or dispute arising out of or in connection with the application, interpretation or performance of these terms of use, the parties shall endeavor to find an amicable solution. Failing amicable resolution of the controversy within a period of two (2) months from receipt by ACCOR of a written notice of dispute sent to it as indicated above, either party may bring it before the French courts of competent jurisdiction, it being specified that that the User may pursue any alternative dispute resolution method and in particular mediation via the European online dispute resolution platform at: http://ec.europa.eu/odr, which will attempt to amicably resolve it.
